Please read these terms carefully before using SpicyHub AI. By using our service, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using SpicyHub AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not access or use the Service. We reserve the right to update these terms at any time, and continued use of the Service constitutes acceptance of any modifications.
2. Who May Use SpicyHub AI & Your Account
SpicyHub AI is for adults only. To create an account or use the Service in any way, you must be 18 or older, or older still if the age of majority where you live is higher than 18, and using a service like this must be legal for you where you are. Signing up or using the Service confirms that both are true. The mature, uncensored (“spicy”) models described in Section 6 come with the same condition: by turning them on, you also confirm that viewing and creating that kind of content is allowed where you live. Give accurate details when you sign up and keep them up to date. Keep your sign-in to yourself: you are responsible for everything that happens through your account. If we have reason to believe an account belongs to someone under the minimum age, we close it.
3. Credits, Payments & Refunds
Everything on SpicyHub AI runs on credits, which come with a monthly plan or a one-time top-up pack; each generation uses credits according to the model and settings you pick. When payments are offered, they are handled by a third-party payment processor, and card and other payment details are entered with that processor. Purchases are final: we only refund one where the law that applies to you gives you that right. Credits already spent on generations are never refunded. Because your credits are available right away, buying them means asking us to start the service at once, and where EU or UK consumer law gives you 14 days to withdraw from the purchase, you accept that this right ends as soon as you start using the credits. That is why new accounts get free credits to try the studio first, and a small top-up pack is the easiest way to decide before buying more or choosing a plan. Plan credits are renewed every billing period, and plan credits you don’t use don’t carry over to the next one; credits from top-up packs don’t expire. Free sign-up credits are given once per internet connection (IP address): another account created from a connection that has already had them gets none. Prices may change, and we will tell you in reasonable time before a change applies to you.
4. Role of SpicyHub AI — Intermediary Between You and AI Providers
SpicyHub AI is a technology intermediary. When you submit a prompt, upload, or other input, SpicyHub AI forwards your request, on your behalf and on your instructions, to the third-party AI model providers listed in Section 7, which generate the output. SpicyHub AI does not author, select, edit, or review the content of individual prompts or outputs, does not exercise editorial control over them, and is not the publisher or speaker of any content you generate. You — the user who submits the request — are the initiator of every generation and are solely responsible for it. Fees you pay cover access to the Service and the onward procurement of generation capacity from these providers. Nothing in these Terms makes SpicyHub AI a co-author, partner, or joint controller of the content you create.
5. Acceptable Use & Prohibited Content
You agree not to use the Service to generate content that: (a) violates any applicable law or regulation; (b) infringes on the intellectual property rights of others; (c) depicts, sexualizes, or exploits minors in any way — the generation of child sexual abuse material (CSAM), child exploitation imagery, or any sexualized content involving minors or persons who appear to be minors is strictly prohibited and will result in immediate account termination and reporting to the relevant authorities (including NCMEC); (d) constitutes non-consensual intimate imagery or deepfake pornography of real individuals; (e) constitutes harassment, threats, or hate speech directed at real individuals; (f) is used for deception, fraud, or impersonation for malicious purposes; (g) generates realistic images of identifiable real persons without their consent; (h) promotes terrorism, extreme violence, or self-harm; (i) depicts sexual violence, bestiality, or non-consensual sexual acts. Before anything is generated, we automatically check the text of every prompt and block requests for certain prohibited content. We reserve the right to terminate accounts that violate these policies without refund and to cooperate with law enforcement where required. 6. Mature ("Spicy") Content
Certain models on the Service (including "Spicy UNCENSORED", "Spicy UNCENSORED Video", "Spicy UNCENSORED Character Swap", "HappyHorse 1.1", and "Wan 2.7 Image") permit mature, uncensored, adult-themed ("spicy") content involving fictional adults or consenting adults. These features are available only to users who meet the age requirement in Section 2. Such content must depict adults only, must never depict real, identifiable persons without their documented consent, may never depict public figures, celebrities, streamers or other creators, coworkers, acquaintances or former partners, whatever consent is claimed, and remains subject to every restriction in Section 5. On Spicy UNCENSORED Character Swap, the character must be a fictional adult and never a real person, not even yourself or someone who consents, and every performer in the source clip must be an adult who agreed to this use of their footage. Generations are private to your account by default. If you choose to share, publish, sell, or distribute such content, you alone are responsible for complying with all laws that apply to you and to your audience, including age-verification, labelling, record-keeping, obscenity, and platform rules. SpicyHub AI does not endorse any content generated with these models.
7. AI Models & Third-Party Services
The Service utilizes AI models developed and operated by third parties, accessed through third-party API providers. Some models are presented under SpicyHub AI product names for ease of reference; these names are branding only and do not represent claims of proprietary model development. In particular: "Spicy UNCENSORED" is powered by ByteDance's Seedream 5.0 image model (offered as Pro, Flash, and Lite versions); "Spicy UNCENSORED Video" is powered by Alibaba's Wan 3.0 video model; "Spicy UNCENSORED Character Swap" uses the same Wan 3.0 model; and "Spicy Imagine Pro" is powered by ByteDance's Seedream image models. Other models, such as HappyHorse 1.1 and Wan 2.7 Image (Alibaba), Seedance (ByteDance), Kling, Veo, GPT Image and Nano Banana, are presented under their own names. The underlying models remain the intellectual property of their respective creators and are used in accordance with their licensing terms. We do not guarantee the availability, accuracy, or quality of any specific model. Models may be updated, replaced, or removed at any time, and the model behind a SpicyHub AI product name may change. Generation results may vary and are not guaranteed to match expectations. We are not responsible for the output of third-party AI models.
8. Generated Content, Ownership & Responsibility
Content generated through the Service is owned by you, subject to the underlying model licenses and these Terms. Each user is solely and fully responsible for the prompts, images, videos, audio, and other inputs they submit and for every output generated from them, and bears full legal responsibility and liability for all content they generate, store, distribute, publish, or otherwise make available using the Service. You are responsible for ensuring that your inputs and generated content comply with all applicable laws and regulations in your jurisdiction, including but not limited to intellectual property, privacy, personality and publicity rights, defamation, and obscenity laws, and that you hold all rights and consents needed for anything you upload. You grant SpicyHub AI a non-exclusive, worldwide license to use generated content for service improvement, marketing, and promotional purposes unless you opt out by emailing [email protected]; SpicyHub AI will not use content generated with the mature (“spicy”) models described in Section 6 for marketing or promotion. SpicyHub AI acts solely as a technology intermediary and is not liable for any consequences, claims, damages, or legal actions arising from your use, distribution, or publication of generated content.
9. Indemnification
You agree to indemnify, defend, and hold harmless SpicyHub AI, its operators, employees, and partners from and against any claims, liabilities, damages, losses, fines, and expenses (including reasonable legal fees) arising out of or related to: (a) the prompts, uploads, and other inputs you submit; (b) the content you generate, store, share, publish, or distribute through or from the Service; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party, including intellectual property, privacy, and publicity rights.
10. Invite & Earn
Invite & Earn is subject to the program terms shown when you apply. Approved members earn a commission of 15–40%, set on approval, on purchases made by people they refer. Commissions start only once payments open, and payouts are made in USDC. SpicyHub AI may change a member's rate, refuse commission on referrals it judges fraudulent, and remove from the program anyone who breaks these Terms.
11. Privacy & Data
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy. Prompts, uploaded images and other inputs, and generated content are transmitted to and processed by the third-party AI providers described in Section 7, subject to their respective privacy policies.
12. Limitation of Liability
The Service is provided "as is" without warranties of any kind. SpicyHub AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, or for content generated by you through third-party AI models. Our total liability shall not exceed the amount you have paid to SpicyHub AI in the twelve months preceding the claim.
13. Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Any unused credits will be forfeited upon termination for cause. You may terminate your account at any time through your account settings.
14. DMCA & Copyright
SpicyHub AI respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please visit our DMCA Policy page at spicyhubai.com/dmca for instructions on filing a takedown notice. We may terminate accounts of repeat infringers.
15. AI-Generated Content
All content generated through the Service is produced by artificial intelligence. Some underlying models add their own provenance signals (such as C2PA Content Credentials or invisible watermarks), but we do not guarantee that every file carries one. You are responsible for disclosing the AI-generated nature of content where required by applicable law. SpicyHub AI does not guarantee that AI-generated content is free from resemblance to real persons, copyrighted works, or trademarks.
