SpicyHub AI's DMCA policy and procedures for reporting copyright infringement and filing counter-notifications, and how to have content removed that shows a person without their consent or a minor (section 7).

1. Introduction

SpicyHub AI respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). We are committed to responding promptly to notices of alleged copyright infringement that comply with applicable law. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please follow the procedures outlined below to file a takedown notice.

2. Filing a Takedown Notice

To file a DMCA takedown notice, you must provide the following information in writing to our designated agent: (a) Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved; (b) Identification of the material that is claimed to be infringing and its location on the Service, with enough detail to allow us to locate it; (c) A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (d) Your name, address, telephone number, and email address so we may contact you; (e) A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; (f) A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

3. Counter-Notification

If you believe that your content was wrongly removed or disabled as a result of a DMCA takedown notice, you may file a counter-notification with our designated agent. Your counter-notification must include: (a) Identification of the material that has been removed or disabled, and the location where it appeared before removal; (b) A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of a mistake or misidentification; (c) Your name, address, and telephone number, along with a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the United States, any judicial district in which SpicyHub AI may be found), and that you will accept service of process from the person who filed the original takedown notice; (d) Your physical or electronic signature.

4. Designated Agent

All DMCA notices and counter-notifications should be sent to our designated agent: SpicyHub AI Legal Team, Email: [email protected]. Please include "DMCA Notice" or "DMCA Counter-Notification" in the subject line of your email to ensure prompt handling of your request.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, SpicyHub AI maintains a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. SpicyHub AI may also, at its sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

6. Good Faith & Misrepresentation

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. Filing a false DMCA takedown notice or counter-notification is a serious matter. We encourage all parties to seek legal counsel before submitting a notice or counter-notification.

7. Reporting a Person Shown Without Consent, or a Minor

You don't need a copyright claim, or an account, to have this kind of content taken down. If something made or shared with SpicyHub AI shows you, or someone you act for, without consent (including sexual or intimate images and deepfakes), or shows anyone who is or appears to be under 18, email [email protected] with "Content report" in the subject line. Tell us: (a) the link to the content, or where you saw it and a screenshot if there is no link; (b) who is shown and how you are connected to them; and (c) an email address where we can reach you, if you want a reply. Never attach or forward a sexual image of a minor; describe where you found it instead. These reports go ahead of every other support message. As soon as we confirm that content breaks these rules we remove it, and in any case within 48 hours of a complete report; then we email you what we did. When content sexualizes a minor, we also close the account that made it and report it to the authorities, including NCMEC.
